{"id":226,"date":"1965-12-19T18:07:55","date_gmt":"1965-12-20T01:07:55","guid":{"rendered":"http:\/\/gashler.com\/nlc\/?p=226"},"modified":"2015-01-17T20:01:02","modified_gmt":"2015-01-18T03:01:02","slug":"pr0v0s-proatased-obsccnity-luw","status":"publish","type":"post","link":"https:\/\/gashler.com\/nlc\/?p=226","title":{"rendered":"Provo&#8217;s Proposed Obscenity Law"},"content":{"rendered":"<p><a href=\"http:\/\/gashler.com\/nlc\/scans\/Herald_-_Xeroxes\/Xerox_PartX_036.jpg\"><img style=\"margin: 12px;\" src=\"http:\/\/gashler.com\/nlc\/default_thm.jpg\" alt=\"Click to see original image\" align=\"right\" \/><\/a>A proposed ordinance\u00a0aimed\u00a0at curbing obscenity will come up for public hearing Monday\u00a0night before the Provo\u00a0City Commission.<\/p>\n<p>The measure is intended\u00a0to strike\u00a0at obscenity in any form,\u00a0but especially on the magazine\u00a0stands and in the movies.<\/p>\n<p>The tentative draft was prepared by the city attorney&#8217;s\u00a0office upon the strong recommendation\u00a0of the Utah County Committee on Children and Youth, the Provo PTA Council working through\u00a0its juvenile protection committee, and the Provo Police Department\u00a0which feels the present law is antiquated and not in compliance with state statutes.<\/p>\n<p>Two main objectives of the bill would be:<\/p>\n<p>1. To give the city law enforcement arm the power to clear printed pornography and obscenity off the news stands upon the filing of a complaint.<\/p>\n<p>2. To empower the law enforcement arm to halt the showing of a movie found to contain obscenity, also upon the issuance of a complaint.<\/p>\n<p>In either case, it is understood, the defendant would come before the court on a misdemeanor charge, punishable by a fine of up in $299 or six months in jail, if found guilty.<\/p>\n<p>The proposed measure is a companion\u00a0law to the curfew ordinance paused some time ago. Also recommended by the committee on children and youth and backed by the PTA and schools, the curfew ordinance has been adopted by several other\u00a0communities since Provo passed it, according to representatives of the committee.<\/p>\n<p>The ordinance makes it unlawful for children under 16 to be loitering on the streets after 10 p.m. Sunday through Thursday and 11 p.m. Fridays and Saturdays. For minors over 16 the deadline is 11 p.m. on the five nights and 1 a.m. on Fridays and Saturdays. The measure also cracks down on sale and use of tobacco by young people under 19, tieing\u00a0in with the state law adopted two years ago. The age on use of beer or alcohol is still 21. It further provides that if cigarette vending machines are accessible to minors, they must be electrically controlled so that they cannot be used except as the proprietor pushes the button.<\/p>\n<p>Both of these ordinances appear to constitute a firm approach\u00a0in controlling factors which contribute to moral decay in youth.<\/p>\n<p>As the committee on children and youth and the PTAs point\u00a0out, the laws should be adopted county-wide. Enforcement and the over-all result will be better if these laws are uniform throughout the area.<\/p>\n<p>Community support is necessary in the case of such laws &#8211; not only in getting the right provisions included, but in enforcement. The law enforcement authorities alone cannot enforce this type of law. It will require the backing of parents, teachers, news stand operators, theaters &#8211; everybody. Passive approval isn&#8217;t sufficient; no law can be effectively enforced if only at handful of\u00a0persons give active support.<\/p>\n<p>Enthusiastic passage of the proposed obscenity law would be a demonstration\u00a0to magazine and movie distributors than the Provo area does not\u00a0want obscene literature and films. The demonstration would lose its punch, however,\u00a0unless the people\u00a0are willing to\u00a0back up the law after it is passed.<\/p>\n<p>Undoubtedly the\u00a0Provo\u00a0City Commission would welcome citizen opinion on\u00a0the proposed\u00a0ordinance at Monday night&#8217;s hearing.\u00a0This is the time to speak up &#8211;\u00a0to let the commissioners\u00a0know whether you feel the measure should be passed, what provisions you would like to have included, and\u00a0whether you would\u00a0be\u00a0willing to support the law.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A proposed ordinance\u00a0aimed\u00a0at curbing obscenity will come up for public hearing Monday\u00a0night before the Provo\u00a0City Commission.
